Terms and Conditions

These Terms and Conditions ("Terms") govern your use of Zer0Email, a service operated by PopPush AI ("we", "us", or "our"). By accessing or using Zer0Email, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Use of the service

You may use Zer0Email only in compliance with applicable laws and these Terms. You are responsible for all activity that occurs under your account. You must be at least 13 years old to use Zer0Email.

2. Accounts

You are responsible for maintaining the security of your account credentials and any connected third-party services (such as Google or Microsoft accounts). You must provide accurate, current, and complete information when creating your account and keep it updated.

You are responsible for all activities that occur under your account. If you believe your account has been compromised, you must notify us immediately at founder@zer0email.com.

3. Service availability

We strive to provide a reliable service, but we do not guarantee uninterrupted or error-free operation. We may:

  • Update, modify, or discontinue features at any time
  • Schedule maintenance that may temporarily affect availability
  • Suspend access for security reasons or Terms violations

We will make reasonable efforts to notify you of planned downtime or significant changes.

4. Acceptable use

You agree not to use Zer0Email for any unlawful, harmful, fraudulent, or abusive purpose. Prohibited activities include, but are not limited to:

  • Sending spam, phishing emails, or unsolicited commercial messages
  • Attempting to gain unauthorized access to other users' accounts or data
  • Interfering with or disrupting the service, servers, or networks
  • Uploading malicious code, viruses, or harmful content
  • Using the service to harass, threaten, or harm others
  • Violating the terms of service of connected third-party platforms (Google, Microsoft)
  • Reselling, sublicensing, or commercially exploiting the service without authorization

We reserve the right to investigate and take appropriate action against violations, including account suspension or termination.

5. Subscriptions and billing

Free tier

Zer0Email may offer a free tier with limited features. We reserve the right to modify or discontinue the free tier at any time with reasonable notice.

Paid subscriptions are billed in advance on a monthly or annual basis, as selected at the time of purchase. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Pricing changes

We may change our pricing at any time. For existing subscribers, price changes will take effect at the start of the next billing cycle. We will notify you at least 30 days before any price increase takes effect.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at founder@zer0email.com. Cancellation takes effect at the end of your current billing period. You will continue to have access to paid features until that date.

Refunds

We offer refunds under the following circumstances:

  • Within 7 days of initial purchase: Full refund if you are not satisfied with the service
  • Service unavailability: Pro-rated refund if Zer0Email is unavailable for more than 72 consecutive hours due to issues on our side
  • Billing errors: Full refund for any incorrect or unauthorized charges

Refund requests must be submitted to founder@zer0email.com. Refunds are processed within 14 business days to the original payment method. Refunds are not provided for partial months of usage or for violations of these Terms.

6. Intellectual property

Zer0Email, including its software, design, branding, trademarks, and content, is owned by PopPush AI or its licensors. These Terms do not grant you any right, title, or interest in Zer0Email's intellectual property except the limited right to use the service as described.

You retain ownership of your email data and content. By using Zer0Email, you grant us a limited license to process your data solely as necessary to provide and improve the service.

7. Third-party services

Zer0Email integrates with third-party services including Google Gmail, Microsoft Outlook, and AI providers. Your use of these integrations is subject to the respective third-party terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.

8. Limitation of liability

To the maximum extent permitted by applicable law:

  • Zer0Email and PopPush AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill
  • Our total liability for any claim arising from or relating to these Terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not liable for damages resulting from: your misuse of the service, unauthorized access to your account, third-party service failures, or events beyond our reasonable control

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify and hold harmless PopPush AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms
  • Your use of Zer0Email
  • Your violation of any third-party rights or applicable laws

10. Termination

We may suspend or terminate your access to Zer0Email:

  • If you violate these Terms
  • If required by law or to protect the service, our users, or our business
  • After providing reasonable notice where practicable

Upon termination, your right to use Zer0Email ceases immediately. We will delete your account data in accordance with our Privacy Policy. You may request a copy of your data before deletion by contacting us.

You may terminate your account at any time by contacting us at founder@zer0email.com.

11. Governing law and dispute resolution

Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Informal resolution

Before filing a formal legal claim, you agree to contact us at founder@zer0email.com and attempt to resolve the dispute informally. We will work with you in good faith to resolve the issue within 60 days.

Arbitration

If informal resolution fails, any dispute arising from these Terms or your use of Zer0Email shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Delaware, unless otherwise agreed. Each party bears its own arbitration costs, except as required by AAA rules.

Class action waiver

You agree to resolve disputes with us on an individual basis. You waive any right to participate in a class action, class-wide arbitration, or any other representative proceeding.

Exceptions

Either party may seek injunctive or equitable relief in a court of competent jurisdiction for intellectual property infringement or unauthorized use of the service.

12. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will notify you by:

  • Sending an email to the address associated with your account
  • Displaying a notice within the Zer0Email application

The updated Terms will carry a revised "Last updated" date. Continued use of Zer0Email after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the service and cancel your account.

13. General provisions

  • Entire agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and PopPush AI regarding Zer0Email
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect
  • No waiver: Our failure to enforce any right or provision does not constitute a waiver
  • Assignment: You may not assign your rights under these Terms without our written consent. We may assign these Terms to an affiliate or in connection with a merger or acquisition
